On September 26, 2017, the Regional Judicial Officer signed an expedited settlement agreement with the Thibeault Corporation of New England (Respondent) resolving violations of Section 311(b)(3) of the Clean Water Act. Respondent operates a garage/fleet refueling facility in Londonderry, NH. An EPA inspection at Respondent?s facility revealed that the facility did not have an SPCC plan available for review. Pursuant to the agreement, Respondent will pay a $3,700 penalty. This settlement will ensure that the Respondent is implementing necessary precautions to reduce the occurrence and severity of oil spills at its facility.
