## Summary

The agreement will require Teck to perform a removal action at four upland residential properties. Teck is a non-liable party for these four properties as a result of a recent 9th circuit opinion. This agreement is entered into under the  rendering care  provision of CERCLA instead of Sections 107(a) and 122 of CERCLA as a result of Teck's non-liable status for these properties within the Site.
