On September 27, 2017, the Regional Judicial Officer for EPA-Region III issued a Final Order concluding a proceeding initiated by EPA under the federal Clean Air Act (CAA) against Latrobe Specialty Metals Company, LLC (Latrobe SMC) for multiple violations of a CAA hazardous air pollutant emission standard and a Title 5 operating permit at Latrobe SMC�s Latrobe, Pennsylvania facility. At the Latrobe facility, Latrobe SMC manufactures specialty metals using,
among other things, an electric arc furnace and an argon-oxygen decarbonization vessel, each of which is a significant emitter of air pollutants. Latrobe SMC had violated multiple requirements of 40 C.F.R. Part 63, Subpart YYYYY, National Emission Standards for Hazardous Air Pollutants for Area Sources: Electric Arc Furnace Steelmaking Facilities ('' 63.10680-10692), and of Title V Operating Permit No. 65-00016 issued by the Commonwealth of Pennsylvania Department of Environmental Protection on January 4, 2013. The emission standard violations reflected an unacceptable carelessness with regard to recordkeeping and reporting requirements of the standard and the operating permit violations involved significant failures to ensure the proper monitoring of air pollution control device performance. The Final Order, which incorporates a Consent Agreement executed by the parties, resolves the alleged past civil violations.
