An email letter of inquiry was sent to the Respondent's Rochester, NY facility on January 26, 2017 to determine regulatory compliance regarding the filing of TRI reports under EPCRA 313. After reviewing documents provided by the facility, it was determined that the facility was required to submit a TRI Form R report for butyl alcohol for 2014 and a TRI Form R report for dichloromethane for 2014 and 2015. The required reports were certified on March 31, 2017. The 2014 reports were over a year late and the 2015 report was 273 days late. The final penalty in the CAFO was $59,290.
