This case seeks to improve public health and safety by decreasing the risk of releases of hazardous chemicals from a natural gas processing plant in Pennsylvania, a state that has not received delegation of the CAA Section 112(r) program. The Regional Judicial Officer issued a Final Order on September 28, 2017, accepting the Consent Agreement to commence and settle violations of CAA Section 112(r)(7), in connection with a natural gas processing plant owned and operated by Emkey Gas Processing, LLC, known as the Emkey ? Union City Plant, and located at 6564 Concord Road, in Union City, Pennsylvania. EPA conducted an inspection of the facility on February 23, 2017, and determined that Emkey failed to prepare and submit a risk management plan for the storage of a flammable mixture of natural gas liquids for more than two years, and failed to prepare a piping and instrumentation diagram for the storage of natural gas liquids. Emkey has corrected all of the identified conditions at the facility. In settlement, Emkey has agreed to pay a cash penalty of $1,000, based on an ability to pay defense. State counterparts have been notified of this action.
