On January 23, 2017, the EPA sent a letter of inquiry to the Respondent at the Kearny, NJ facility, to determine compliance with the filing of Toxics Release Inventory (TRI) Form R reports under Section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA) for certain regulated chemicals. Documents submitted to EPA indicated that Form R reports should have been filed for benzo(g,h,i)perylene, copper, and polycyclic aromatic compounds for calendar year 2015. The required reports were not certified and submitted until January 23, 2017, resulting in violations. The company has come into compliance and paid a penalty of $52,000.
