Summary

On September 27, 2017, the Region III Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and the Federal Bureau of Investigation that initiates and settles alleged violations of Virginia Hazardous Waste Management Regulations and CAA reporting and record keeping requirements at the FBI Academy in Quantico, Virginia. This settlement ensures that the FBI Academy complies with hazardous waste management requirements that are designed to minimize the potential for accidental releases of hazardous materials and reporting and record keeping requirements designed to demonstrate compliance with CAA Hazardous Air Pollutant regulations that reduce harmful emissions to our air. EPA alleged that the FBI Academy had operated a hazardous waste storage facility without a permit; failed to make hazardous waste determinations; and failed to timely submit a Notice of Compliance Status and maintain on-site tune-up reports regarding the FBI Academy?s oil-fired boilers. The CAA requirements at issue here are part of a direct implementation program. The Virginia Hazardous Waste Management Regulations are part of Virginia?s delegated RCRA Subtitle C program and are directly enforceable by EPA. The Region notified Virginia of its intent to take this action and the Commonwealth raised no objections.
