This case involves the Defendant's violation of requirements under 40 CFR Part 62, Subpart LLL at its then-functional municipal sewage sludge incineration unit, which it operated as part of the Regional Waste Water Treatment Facility in West Deptford, New Jersey. Defendant has since permanently shut down the sewage sludge incineration unit. Under this consent decree, Defendant will pay a monetary civil penalty of $132,500, divided equally between the United States and New Jersey as co-plaintiffs. Defendant will also complete a state-only project to install 3 electric vehicle charging stations.
