The Consent Agreement will commence and settle an enforcement action against the Respondent, which owns and operates a polystyrene manufacturing facility located in Middletown, New York. Execution of the attached CAFO will resolve the civil administrative action against the Respondent, for violation of the New York SIP good maintenance provision resulting in release of excess VOCs. The CAFO will require the Respondent to pay a civil penalty of $15,000 to resolve this violation.
