On September 7, 2017, a CWA Class I CAFO between the EPA and Super Concrete Corp ( SCC ) was filed in Region III. The CAFO resolves violations of Sections 402 and 301 of the CWA involving SCC's failure on at least 13 occasions to comply with its NPDES permit operation and monitoring obligations at its Washington DC area concrete aggregate processing facility. The CAFO requires that SCC pay a penalty of $27,250.00. Under the CAFO, SCC also agreed to implement SOPs to prevent the alleged violations from recurring. Implementing the SOPs to reduce or eliminate future discharge violations will protect the receiving waters by reducing impacts from discharge limit exceedances. The SOPs will also ensure that the respondent better gathers compliance data and reporting information required by its permit. EPA communicated with the District of Columbia so that the City was aware of EPA?s enforcement activities and did not object to the proposed actions.
