On October 12, 2017, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) to Athlon Solutions LLC, Pasadena, Texas for violations of EPCRA Section 313 reporting requirements for toxic chemicals. Specifically, the facility was identified as having discrepancies in its reporting for ammonia (2013) and diethyl sulfate (2015). The violations were discovered from the Region 6 TRI Program desk top inquiries. Information collected from EPCRA reporting requirements supports informed decision- making by industry, government, non-governmental organizations, and the public, while at the same time encouraging facilities to reduce emissions/pollution/waste. The CAFO requires certification of compliance with reporting requirements and imposes a penalty of $9,298. EPA directly implements the EPCRA 313 program as it has not been delegated to the states.
