On November 28, 2017, Region 10 filed a compliance order on consent (COC) resolving violations of the Clean Water Act by the City of Nezperce, located in Nezperce, Idaho. Respondent, which operates a wastewater treatment plant, exceeded its NPDES permit limits for E. coli, total suspended solids (TSS), biochemical oxygen demand (BOD), total residual chlorine (TRC), and pH. The number of violations giving rise to this action have significantly declined from those recorded in previous years, and Respondent has initiated Facility upgrades to prevent future violations. Under the AOC, EPA and Respondent agree to a timeline for completion of the multi-phase upgrade project. This enforcement action will reduce the quantity of harmful pollutants entering the Clearwater River and improve the River's ability to support cold-water aquatic life and primary contact recreation.
