Summary

On January 24, 2018, EPA Region 10 entered a consent agreement and final order to resolve allegations that Concentrates, Inc., Milwaukie, Oregon, violated the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Concentrates distributed and sold the unregistered pesticides: Vinegar Concentrate (20% acetic acid), Diatomaceous Earth, and Boric Acid Granules in violation of FIFRA Section 12(a)(1)(A) of FIFRA, 7 U.S.C. 136j(a)(1)(A). All products posed a risk of harm to human health as distributed. Acetic acid is particularly dangerous because it can burn the eyes and skin if not handled according to EPA approved labeling. The company also failed to register as a pesticide-producing establishment with EPA, as required by Section 7 of FIFRA, in violation of Section 12(a)(2)(L), 7 U.S.C. 136j(a)(2)(L). The Respondent has agreed to pay a penalty of $82,136.
