On November 21, Region 3 filed an Expedited Settlement Agreement which settled EPA's penalty claim for violations of CWA Section 311 (j) at the Fort Beeler Cryogenic Plant facility located in Cameron, West Virginia. The facility failed to provide a complete Professional Engineer certification, provide a complete facility diagram, provide a complete listing of all bulk storage containers, provide a complete discussion of visual inspection procedures, maintain visual inspection records for a period of three years, provide adequate containment for all bulk storage containers. The respondent has agreed to pay a cash penalty of $1,125 to settle the matter.
