On December 4, 2017, a Consent Agreement and Final Order (CAFO) was issued to Solenis, LLC of Wilmington Delaware. EPA had conducted a FIFRA producer establishment inspection at a Union Carbide, LLC facility in Institute, WV and collected labels and sales records for the pesticide Biosperse 550. This label was missing required instructions for cleaning pesticide residues from the empty container, in violation of the FIFRA container containment rules. Solenis, LLC is the product registrant and recipient of the product, and is ultimately responsible for the label language. EPA assessed a penalty of $99,000.
