Respondent failed to provide immediate notification to the NRC of a release of a hazardous substance in an amount equal to or greater than the Reportable Quantity (RQ) under CERCLA. Under EPCRA 304(a), Respondent failed to immediately notify the State Emergency Response Commission (SERC) and the Local Emergency Planning Committee (LEPC) of said release of a hazardous substance in an amount equal to or greater than the RQ. Respondent and USEPA agreed to a civil penalty of $34,170 to settle this case.
