Summary

On January 11, 2018, the Region settled FIFRA violations for $500 based on Lico, Inc. (Lico) inability to pay a higher amount. Distribution, sale and use of misbranded pesticides can cause adverse effects to human health and the environment. The pesticide labels for three (3) of Lico's products: Triple Crown Plus, Triumph 7 and Lemonfect were each misbranded in that words, statements or other information required to be included on their EPA-accepted labels to protect human health and the environment were either omitted from or misstated on each label. Lico mixes and packages these antimicrobial pesticides at its McKeesport, Pennsylvania facility. These FIFRA violations were discovered by a credentialed FIFRA inspector from EPA's partner, the Pennsylvania Department of Agriculture, during a producer establishment inspection of Lico. Under FIFRA, it's unlawful to distribute or sell any pesticide which is unregistered or misbranded. This matter was initiated based on a May 5, 2017 Show Cause Letter issued to Lico to begin settlement negotiations.
