On January 29, 2018, Region 1 settled an administrative case with Guida-Seibert Dairy Company to resolve violations of the chemical accident prevention provisions of Section 112(r) of the Clean Air Act (CAA), 42 U.S.C. ? 7412(r), and the Risk Management Plan (RMP) regulations promulgated thereunder at 40 C.F.R. Part 68 and a violation of Section 103 of CERCLA, 42 U.S.C. 9603(a) and 40 C.F.R. 302.6(a). The alleged violations relate to the design and operation of the ammonia cooling system at a dairy processing facility in New Britain, CT as well as the failure to submit a timely response to the National Response Center regarding an ammonia release. The settlement requires the payment of a $157,214 penalty. Complying with RMP regulations helps companies prevent accidental releases of extremely hazardous substances. EPA implements the RMP and CERCLA Section 103 requirements directly in Connecticut, but EPA notified the State regarding the settlement upon filing.
