Region III Enters into an Expedited Settlement Agreement with EPP - Besche Acquisition, LLC for violations of RCRA Subtitle I. On February 22, 2018, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement negotiated pursuant to Section 9006 of RCRA to settle violations of RCRA Subtitle I, and Maryland's federally authorized underground storage tank (UST) program, by EPP - Besche Acquisition, LLC. Respondent is the owner and operator of five USTs located at the Chestertown Besche facility in Chestertown, Maryland. The violation is a failure to conduct tank release detection on one of the USTs at the facility. The violation was discovered through information collected during an inspection at the facility on May 11, 2017, and also from information provided after the inspection. Under the terms of the settlement, Respondent has paid a civil penalty in the amount of $1,700.00 and has returned to compliance with the violations cited.
