On March 5, 2018, EPA Region III issued an Administrative Settlement Agreement and Order on Consent (Order) to Eagle Natrium, LLC, the owner and operator of a chlorine manufacturing facility in Proctor, West Virginia. At an inspection of the facility, EPA determined that Eagle Natrium, LLC violated CAA Section 112(r)(1), because of inadequate labeling of hydrogen gas piping, and violated CAA Section 112(r)(7), because of its inadequate labeling and maintenance of chlorine gas piping. Under the Order, the company will implement improvements at the facility to ensure compliance with applicable regulations and industry codes in order to improve public health and safety by decreasing the risk of releases of hazardous chemicals. West Virginia has been notified of the enforcement action, but has not received delegation of Section 112(r)(1) and (7) of the CAA.
