Summary

On December 20, 2017, EPA Region III filed a signed Consent Agreement and Final Order (CAFO) resolving an action against James Austin Company for suspected violations of Section 112(r)(7) of the Clean Air Act, in connection with its household cleaner and laundry aid manufacturing plant in Mars, Pennsylvania. CAA Section 112(r) is implemented directly by EPA in most of Pennsylvania, including Butler County. The Pennsylvania Department of Environmental Protection is aware of this action. Specifically, EPA alleged that Respondent's facility failed to comply with the following Part 68 requirements: document the identity of persons responsible for implementing requirements and define lines of authority; develop and implement written procedures for safely conducting activities for each covered process, provide annual certifications for operating procedures; provide required training for operators; prepare and implement maintenance procedures for the chlorine process; and involve employees in the process safety management program. The CAFO requires Respondent to pay $35,043.00 in civil penalties.
