This case involves the manufacture and sale by New Flyer of America Inc. (?New Flyer?) of 2,399 uncertified transit buses. New Flyer is a manufacturer of transit buses with manufacturing facilities in Crookston and St. Cloud, Minnesota, and Anniston, Alabama. New Flyer manufacturers several models of transit buses that are powered by diesel, diesel-electric hybrid, and compressed natural gas, as well as zero-emission electric buses and trolleys.
EPA discovered the 2,399 certification violations by issuing an Information Request to New Flyer, pursuant to section 208 of the Clean Air Act, on June 4, 2015. The Information Request concerned, among other things, the certification status of transit buses that New Flyer manufactured and sold for use in the U.S. after January 1, 2014.
As part of the settlement, New Flyer agreed to pay a civil penalty of $575,000 to the U. S. Treasury.
