On April 17, 2018, the Region III Regional Judicial Officer signed a Final Order approving a Consent Agreement between EPA and Eby's Oil, Inc., that initiates and settles an action against Eby's Oil for alleged violations of the CWA's SPCC requirements. The Eby's Oil facility is located on the shoreline of the Conestoga River at 425 White Oak Road in New Holland, Pennsylvania. Compliance with spill prevention regulations helps alleviate threats of potential discharges into nearby waterways and safeguards nearby Pennsylvania communities. EPA discovered the alleged violations during a February 2, 2017 SPCC compliance inspection at the Eby's Oil facility. EPA issued a show cause letter to Eby's Oil on January 25, 2018. Inspectors from PADEP attended the SPCC compliance inspection, and the Acting Deputy Secretary of PADEP's Office of Water Programs and the Regional Director of PADEP's Southcentral Regional Office were notified of EPA's enforcement action. The SPCC program is directly implemented by EPA and is not delegated to states.
