On April 16, 2018, EPA Region III filed a Consent Agreement and Final Order simultaneously commencing and concluding an administrative enforcement action against T.S.G. Construction, LLC. (Respondent) for alleged violations of TSCA and EPA's RRP Rule in connection with a renovation at the University Towers, two 15-story brick high-rise condominium buildings located in suburban Silver Springs, Maryland. Respondent, a Virginia limited liability company that performs commercial and institutional building restoration activities, was hired as a subcontractor to perform drywall and building component renovation and repair activities in common areas of the University Towers under the supervision of a general contractor, HBW Properties, Inc. Alleged violations included failing to obtain a lead-safe firm certification and use lead-certified renovators to perform the renovation activities, failing to comply with various interior lead dust containment work practice standards and employing restricted work practices. Under the terms of the CAFO, Respondent will pay a civil penalty of $25,000. The Virginia Department of Health's Lead-Safe Virginia Program was notified and did not object to this action.
