Nestle Prepared Foods Co. Inc. in Jonesboro, AR, was inspected on March 22, 2017 to determine compliance with Section 313 of the Emergency Planning & Community Right-to-Know Act (EPCRA). It was found that the facility violated Section 313 of EPCRA by failing to report its offsite transfers of nitric acid to a publicly owned treatment works for the 2014 and 2015 calendar years. Information collected pursuant to EPCRA ? 313 supports informed decision-making by industry, government, non-governmental organizations, and the public, and it encourages facilities to reduce their emissions. The program is implemented by the EPA, as it has not been delegated to any state. The program contact with the Arkansas Department of Emergency Management was notified but did not attend the inspection. A Consent Agreement and Final Order was issued on April 12, 2018. Nestle has corrected the violations and has agreed to pay a civil penalty of $27,720.
