The Department of Justice and EPA Region 9 have reached settlement with Apache Nitrogen Products, a fertilizer manufacturer located near St. David, Arizona, for violations of CAA 112(r), CERCLA 103, and EPCRA Section 304. Apache Nitrogen will perform significant injunctive relieve over the next 3 years, including a process safety culture audit, preventative maintenance software upgrades, and installation of an ammonia monitoring system. Apache Nitrogen will pay a civil penalty of $1,500,000.
