On November 6, 2017, an authorized representative of the EPA conducted an inspection of the Always Bagels facility located at 3010 Hanford Drive in Lebanon, PA, lo determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the Clean Air Act (the Act or CAA). EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically: (1) document that equipment complies with recognized and generally accepted good engineering practices, (2) certify that operating procedures are current and accurate, (3) inspect process equipment in accordance with industry standards, and (4) certify that the stationary source has been evaluated for compliance with the prevention program requirements at least every three years.
