EPA Region 5, Ridge Prairie Farms Inc. and Alan Begole (Respondents) entered into a Consent Agreement and Final Order under Section 309(g) of the CWA resolving EPA's claims that Respondent violated Section 301 of the CWA, 33 U.S. C. ? 1311, which prohibits any person from discharging any pollutant from any point source into navigable waters except, among other things, in accordance with the terms of a valid permit issued by the U.S. Army Corps of Engineers (ACOE) under Section 404 of the CWA, 33 U.S. C.? 1344.
In Count 1, Respondents placed dredged and fill material into Little Silver Creek to straighten a portion of the stream without a permit. In Count 2, Respondents placed dredged and fill material into an unnamed tributary to Ogles Creek, filling a portion of the stream without a permit. The properties are located in St. Clair County, Illinois.
Respondents agree to pay an inflation-adjusted penalty amount of $20,000 applicable to these violations.
