On May 24, 2018, EPA Region III filed a Consent Agreement and Final Order simultaneously commencing and concluding an administrative action proceeding against Distinct Construction, Inc. for alleged violations of TSCA and EPA's RRP Rule in connection with 2015 renovations for compensation on pre-1978 housing located in Dallastown, Pennsylvania. The case was initiated as a result of a tip by a tenant residing at one of the properties being renovated complaining of suspected noncompliant work practices. The alleged violations included failing to post warning signs, failing to cover ground with plastic sheeting, failing to contain waste, failing to take extra precautionary measures, failing to be firm certified, failing to obtain acknowledgement of receipt of the EPA-approved lead hazard pamphlet, and failing to retain records demonstrating compliance with lead safe work practices. Per the terms of the CAFO, Respondent will pay a civil penalty in the amount of $2,497. The Pennsylvania Department of Labor & Industry's Bureau of Occupational & Industrial Safety was notified and did not object to this action.
