On May 24, 2018, EPA Region III issued an Administrative Settlement Agreement and Order on Consent (Order) to US Foods, Inc., the owner and operator of a food distribution facility in Allentown, Pennsylvania, in order to improve public health and safety by decreasing the risk of releases of hazardous chemicals. At an inspection of the facility, EPA determined that US Foods, Inc. violated CAA Section 112(r)(7), because of its failure to protect evaporators in its ammonia refrigeration system from the risk of impact and its failure timely correct deficiencies in ammonia refrigeration system piping. Under the Order, the company will implement improvements at the facility to ensure compliance with applicable regulations and industry codes. Pennsylvania has been notified of the enforcement action, but has not received delegation of Section 112(r)(1) and (7) of the CAA.
