On May 2, 2018, EPA Region 6 issued a consent agreement and final order (CAFO) under its authority pursuant to section 3008a of the Resource Conservation and Recovery Act (RCRA) to Braskem America, Inc. for the facility located in La Porte, Texas. The CAFO was issued in response to the following violations of RCRA: 1)Failure to notify the regulatory agencies of hazardous waste activity; 2)Failure to maintain a complete Hazardous Waste Contingency Plan; 3)Failure to file a complete hazardous waste biennial report. The CAFO requires Braskem America, Inc. to document and certify compliance and pay a civil penalty of $24,200 for the alleged violations.
