## Summary

On or about March 11, the Region modified the above captioned AOC for Remedial Design.  This modification, which has undergone OECA consultation, provides that, in the event of the insolvency of any Respondent, EPA agrees to access such Respondent?s financial assurance and shall make those funds available to the remaining Respondents in order to facilitate the completion of the Work.  However, this modification does not apply in the event that EPA triggers a work takeover.
