On June 13, 2018, EPA Region 6 issued a Proposed Administrative Complaint (Complaint) under its authority pursuant to Section 1423(c) of the Safe Drinking Water Act (SDWA) to Diamond 3S, LLC (Respondent) located in Osage County, Oklahoma. The Complaint was issued in response to violations of operating an injection well (the Well) in a manner that could allow for fluids containing contaminants to flow through the well into underground sources of drinking water. The Complaint is proposing a $6,000.00 penalty to the Respondent and to plug the well or to repair the well and demonstrates the well's mechanical integrity of its tubing, packer, and casing.
On January 21, 2020, a Default Order was issued by the court requiring the Respondent to:
Pay a $6000 penalty, and; plug the Well pursuant to 40 CFR Section 147.2905 or repair the Well and demonstrate the mechanical integrity of the casing, tubing, and packer in accordance set forth at 40 CFR Section 147.2912(a)(1)(I).
