EPA Region 10 enters into an Administrative Order on Consent with the City of Heyburn, Idaho for Clean Water Act and NPDES Permit Violations
On August 6, 2018, EPA Region 10 entered into an Administrative Order on Consent (AOC) with the City of Heyburn, Idaho resolving violations of the Clean Water Act and the City?s National Pollutant Discharge Elimination System (NPDES) Permit. Respondent, which operates a wastewater treatment plant, exceeded its NPDES permit limits for E. coli, total suspended solids (TSS), total phosphorus, and total fecal coliform. The number of violations giving rise to this action have significantly declined from those recorded in previous years. However, further changes are required to bring the Facility into full compliance with its permit. To that end, the Respondent has initiated Facility upgrades at an estimated cost of $5,503,000. Under the AOC, EPA and Respondent agree to a timeline for completion of the multi-phase upgrade project. The Environmental Benefit of this enforcement action will be the elimination of effluent discharges containing pollutants above the permitted limit.
