LCD issued a Consent Agreement and Final Order (CAFO) to Earthworx, Inc. (Earthworx) of Brookville, PA for two violations of FIFRA. As a result of a tip received from the public, Pennsylvania Department of Agriculture conducted a for-cause inspection at Earthworx to determine if Earthworx was repackaging the herbicide Razor Pro from bulk containers into customer-provided containers. Earthworx does not have an EPA registered establishment number, and does not have a repackaging agreement with the registrant of Razor Pro, Nufarm Americas. The CAFO includes two violations: distribution and/or sale a pesticide without having a registered EPA producer establishment, and failure to have a repackaging agreement with the registrant of Razor Pro (EPA Reg. No. 228-366), Nufarm Americas (EPA Company No. 228). Earthworx paid a civil penalty amount of $2,338.
