## Summary

On July 16, 2018, Region 1 filed a consent agreement and final order (CAFO) resolving violations of the Clean Water Act and the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA) by Bath Iron Works.  Bath Iron Works operates a naval destroyer shipyard facility located in Bath, Maine.  EPA alleged that Bath Iron Works violated provisions of the Maine multi-sector general permit for stormwater discharges (ME MSGP) by failing to adequately implement best management practices as described in its stormwater pollution prevention plan to minimize the impacts of stormwater discharges on the Kennebec River.  EPA also documented ongoing discharges of process wastewater from truck washing activities, which were not authorized by any NPDES permit.  In addition, EPA determined that the facility failed to timely file Toxic Release Inventory Reporting (TRI) forms for four chemicals in each of reporting years 2013, 2014, and 2015.  Bath Iron Works has certified that it has come into compliance with the ME MSGP and the TRI reporting requirements.  Bath Iron Works has agreed to pay a penalty of $355,000 to resolve the violations.  EPA worked in close coordination with MEDEP on this case.
