Region 1 has sent a referral to the U.S. Department of Justice requesting that a proof of claim be filed in the bankruptcy of Nashua Corporation (being administered in conjunction with the bankruptcy of Cenveo, Inc.). Nashua Corp. operated a paper products manufacturing facility in Merrimack, NH from 1969 until 2016. The operations led to releases of toluene and polychlorinated biphenyls into the soil and groundwater. EPA is working with the State of New Hampshire to address the contamination. Nashua Corp. is monitoring groundwater pursuant to a permit from the New Hampshire Department of Environmental Services. EPA anticipates working with Nashua Corp. in the future to address the PCBs pursuant to the Toxic Substances Control Act. Region 1 has requested that DOJ file a proof of claim in the bankruptcy to ensure that the bankruptcy does not impact Nashua Corp.?s obligations under TSCA.
