On June 6, 2018, EPA Region 6 issued Consent Agreement and Final Order under its authority pursuant to RCRA to Rockwater Energy Solutions, LLC located in Snyder, TX and Hobbs, New Mexico. The consent agreement and Final Order was issued in response to violations of: Hobbs, Counts for New Mexico:
1) Failure to submit Timely and Complete RCRA 3010 Notification.
2) Failure to Make hazardous waste determination .
3) Failure to Comply with the One-Time Written Notice Requirement, LDR.
4) Failure to Comply with the Applicable Generator Requirements.
The Compliance order in the CAFO requires rockwater Energy Solutions, LLC to certify and document compliance and pay a penalty of $515,119.
