On September 12, 2019, final judgments of $48,000 plus post-judgment interest were issued against the Defendants for contempt sanctions incurred between June 5, 2019 and September 9, 2019. Both Defendants were previously found in contempt of the Court, in May 2019, for failing to comply with the Court's previous orders and with EPA's administrative subpoena duces tecum issued in June 2017. In the May Contempt Order, the Court ordered each Defendant to pay, to the Clerk of Court of the Eastern District of New York (EDNY), a contempt sanction in the amount of $500 per diem until such date as both complied with the subpoena. As of September 9, 2019, neither Defendant had complied with the subpoena, and the contempt sanction payable by each had reached $48,000, prompting the US Attorney's Office for the EDNY to seek judgment.
