Dober Chemical Corporation Enters into Consent Agreement and Final Order with EPA and Agrees to Perform Compliance Tasks. On July 18, 2018, the R3 Regional Judicial Officer entered a Consent Agreement and Final Order requiring Dober Chemical Corporation, located in Hazelton, Pennsylvania, to perform injunctive relief for a violation of RCRA regulations that EPA identified during an inspection on May 18, 2016. This compliance order was issued under Section 3008(a) of RCRA, 42 U.S.C. ?? 6928(a). Although EPA did not obtain civil penalties as part of this Final Order, Section 3008(c) of RCRA, 42 U.S.C. ? 6928(c), provides for the assessment of civil penalties for Respondent?s noncompliance with the compliance order. Dober Chemical Corporation manufactures additives for coolants used in heavy duty diesel engines at its Hazelton Facility. During EPA?s Compliance Evaluation Inspection of the Facility on May 18, 2016, evidence was uncovered indicating Dober Chemical Corporation had not performed hazardous waste determinations on three totes of hazardous waste. Dober Chemical Corporation will draft and implement a Standard Operating Procedure to ensure all solid waste material at the Hazelton Facility is subject to a hazardous waste determination.
