On August 1, 2018, EPA filed an Administrative Order on Consent (AO) settling violations against PRC-ASC, Desoto International, Inc. (ASC) located in Grand Prairie, Texas of the Resource Conservation and Recovery Act (RCRA). The AO alleges four violations and requires ASC to comply with RCRA and its implementing regulations, 90 days from the effective date of the AO. EPA Region 6 conducted a Compliance Evaluation Inspection at ASC in May 2017, and with ASC's cooperation, EPA and ASC effectively negotiated an AO. The AO alleges RCRA violations under Section 3010 of RCRA and 40 C.F.R. Part 262 to include: (1) Failure to Meet Preparedness, Prevention, and Emergency Procedures Requirements; (2) Failure to Meet Inspection Requirements; (3) Failure to Manage Hazardous Waste Containers in a Manner that Prevents Ruptures or Leaks; and (4) Failure to Properly Label Hazardous Waste in a Satellite Accumulation Area; and (5) Failure to Properly Manage Excess Waste from a Satellite Accumulation Area.
