EPA entered into an Expedited Settlement Agreement (ESA) with North Coast Sea-Foods Corp. for alleged violations of Section 312 of EPCRA at its facility in New Bedford, Massachusetts. The company failed to report to EPA its use of several chemicals including sulfuric acid, liquid nitrogen, and chlorodifluoromethane. Enforcement of the EPCRA 312 reporting requirements ensures that state and local first responders are able to properly plan for chemical releases and other emergency response situations. The company will pay a penalty of $5,000 and has certified that it has corrected the violations. EPCRA Section 312 enforcement is not a delegated program.
