On August 15, 2018, EPA Region 6 issued a Administrative Compliance Order On Consent (ACO) under its authority pursuant to Section 113(a)(3) of the Clean Air Act to BASF Corp. located Geismar, Louisiana. The ACO was issued in response to violations of: 40 C.F.R. 63.11(b)(6) at the following flares at various times from July 1, 2011, to October 15, 2014:
a. Aniline Y502 Flare, a non-assisted flare;
b. Aniline Y503 Flare, a non-assisted flare
The ACO requires BASF Corp. to comply with 40 C.F.R. 63.11(b)(6) at all times.
The ACO was executed on August 15, 2018.
