EPA Region III Settles CAA Matter with the Domtar Mill located in Johnsonburg, Pennsylvania [Docket No. CAA-03-2018-0121]. The Regional Judicial Officer issued a Final Order on September 4, 2018 accepting the Expedited Penalty Action and Consent Agreement to commence and settle violations of CAA Section 112(r)(7). During the Risk Management Program (RMP) inspection on June 7, 2018, it was found that the facility violated one aspect of the regulation. Specifically, the owner or operator experienced an accidental release on July 16, 2015 that met the five-year accident history reporting criteria (as described at 68.42) subsequent to April 9, 2004 and failed to submit the information required at 68.168, 68.170(j) and 68.175(l) within six months of the release or by the time the RMP was updated as required at 68.190, whichever was earlier [68.195(a)]. Domtar Mill has agreed to pay a cash penalty of $2,000.00.
