Summary

On September 12, 2018, EPA filed a Consent Agreement and Final Order, which initiated and settled EPA?s penalty claim for violations of CAA Section 112(r)(7) against J&J Snack Foods Corp., doing business as MIA Products Company (Respondent), in connection with Respondent?s facility located in Moosic, PA. The SCAFO alleges that the Respondent stored and used over 32,000 pounds of anhydrous ammonia, a regulated substance, at its facility and certain equipment did not comply with generally accepted engineering standards. The Consent Agreement additionally alleges that the facility failed to complete a compilation of certain written process safety information. The RMP regulations are designed to protect human health and the environment by ensuring the safe management of hazardous substances and help prevent or minimize chemical accidents. Respondent has agreed to pay a penalty of $23,226. The CAA Section 112r program is not delegated in the State of Pennsylvania. State counterparts have been notified of this action and have not raised any objections.
