On September 13, 2018, EPA Region III filed a Consent Agreement and Final Order simultaneously commencing and concluding an administrative action proceeding against American Heritage Property Management, LLC ( AHPM ) for alleged violations of requirements of TSCA, RLBPHRA, and EPA's Disclosure and RRP Rules. The Disclosure Rule violation was discovered as a result of tip from a tenant whose children tested positive for elevated lead blood levels. EPA determined that AHPM failed to ensure that a lead hazard information pamphlet was provided to the lessee in connection with a January 28, 2015 lease transaction involving target housing in Manheim, Pennsylvania. Through a separate routine investigation, EPA also determined that AHPM failed to obtain firm certification, failed to obtain acknowledgement of receipt of the lead hazard information pamphlet, and failed to retain records demonstrating compliance with lead safe work practices in connection with a 2016 renovation for compensation at target housing in Lancaster, Pennsylvania. Per the terms of the CAFO, Respondent will pay a civil penalty in the amount of $16,450. The PA Department of Labor & Industry?s Bureau of Occupational & Industrial Safety was notified and did not object to this action.
