This is a Consent Agreement and Final Order (CA/FO) between US EPA and Smith Waterhouse Family of Koloa (Respondent), of Watertown, Massachusetts, for Respondent's alleged violation of the Safe Drinking Water Act regulations for underground injection control wells at its property at 5408 Koloa Road in Koloa, Hawaii. Respondent agreed to pay a $81,549 civil penalty, and to close the two Large Capacity Cesspools at the property and install replacement waste collection systems. This CAFO has been terminated as of 8/19/20. Smith Waterhouse Family of Koloa has comply with all Safe Drinking Water Act regulations, which include the Underground Injection Control Class V well requirements at 40 C.F.R. Part 144.
