A Notice of Warning will be issued to West Chester Agway for violations of FIFRA concerning three non-compliant products, two pesticide devices and one pesticide. One of the pesticide devices appears to be produced in an establishment that is not registered with EPA. The production of a pesticide or active ingredient in an unregistered establishment is a violation according to FIFRA Section 7 and 12(a)(2)(L). The other device and the pesticide are considered to be misbranded, because the label does not clearly identify the establishment, at which final production took place. This is violation according to FIFRA Sections 12(a)(l)(E) and 2( q)(l )(E).
