On August 7, 2018, EPA issued an administrative order on consent to Northern Pelagic Group, LLC of New Bedford, Massachusetts. The company, a major supplier of frozen fish, uses anhydrous ammonia in its refrigeration system. An EPA inspection of the facility revealed that the company had violated many risk management program (RMP) requirements of 40 C.F.R. Part 68, including failing to file a risk management plan with EPA. Although many of the deficiencies have been addressed since EPA?s inspection, the company will be required to address remaining concerns regarding the ventilation system, among other things, at their facility. The RMP program is not delegated to Massachusetts.
