On September 26, 2018, Region 5 executed a Consent Agreement and Final Order (CAFO) with Mark Benner DBA Mark's Handyman Service. The CAFO commences and concludes a proceeding identifying alleged violations of the Toxic Substance Control Act (TSCA), specifically of the Lead Renovation, Repair and Painting Rule (RRP Rule). Region 5 alleged that in calendar year 2015, Mark's Handyman Service performed a renovation and failed to: establish and maintain all records necessary to demonstrate compliance with the RRP Rule for a period of 3 years following completion of renovation activities; ensure that all individuals performing the renovation activities on behalf of the firm were certified renovator or had been trained by a certified renovator; ensure that a certified renovator was assigned to each renovation performed by the firm; and, clean the work area until no dust, debris or resident remains after completion of the renovation. Mark's Handyman Service paid a $250 penalty.
